Fit Note Guidance for Employers: When to Ask, 7-Day Rule

Employers can ask for a fit note when an employee has been off sick for more than seven days in a row. Count non-working days too, accept self-certification before that, and use the note to plan support and a return, which can happen before the note ends.

Count calendar days, not shifts

The threshold is more than seven days in a row, including weekends and other days the employee would not normally work. Use self-certification for the first seven days rather than routinely requiring a GP appointment.

The reporting deadline and the fit-note deadline are different. Staff should report the absence within the deadline in your policy, or seven days if none is set. You cannot withhold SSP simply because the fit note is provided late.

Day 8 onwardsThe following Wednesday, if still unwellThe absence now exceeds seven days, so request a fit note.

Check who issued the note and the dates

A fit note can be issued by a GP or hospital doctor, registered nurse, occupational therapist, pharmacist or physiotherapist. GOV.UK accepts printed and digital notes.

The professional must be suitably trained and able to assess fitness for work. A high-street pharmacy does not necessarily provide fit notes. Check the issuer's name or signature, their profession, the practice details and the period covered.

If you agree, another suitable form of evidence can be used instead, such as an Allied Health Professional Health and Work Report. Keep a clear note of what evidence you accepted.

Turn the advice into a practical discussion

Talk with the employee about what would make work manageable. Depending on the circumstances, adjustments could involve duties, working patterns, breaks, equipment or a phased return. Decide what is practical and agree when to review it.

If disability is relevant, consider the duty to make reasonable adjustments. Avoid treating a suggested return date as a guarantee that the employee will be able to perform every task. Managers need enough information to plan safe work; they do not need to circulate a diagnosis to the whole team.

  • Agree the proposed hours and duties in writing.
  • Identify the person responsible for arranging each adjustment.
  • Set a review date and a way for the employee to report difficulties.

What to record and how long to keep it

Record the dates covered, relevant work advice, agreed actions and a review date. The employee keeps the original; you can retain a copy where needed for your sickness process.

Health information needs special protection. Identify and document your lawful basis and special-category condition before processing it. Limit collection to what the purpose requires, restrict access and explain the use of the information to workers.

There is no universal six-year retention rule for every fit note. Set and document a retention schedule based on the purpose, any applicable legal requirements and the need to justify keeping the record. Review it periodically and erase or anonymise information when it is no longer needed. A general employment-record policy should not automatically determine how long you retain every medical document.

Common fit-note questions from employers

Separate evidence checks from decisions about sick pay and a safe return. Use the note alongside a conversation with the employee, rather than treating a date or tick box as a complete return-to-work plan.

Fit-note checks and next steps
QuestionWhat to do
What if a note is late?Follow up on the evidence. Do not withhold SSP just because the fit note arrives late; the rules for reporting an absence are separate.
What if we cannot agree adjustments? After considering support and any reasonable-adjustment duties, the same 'may be fit' note can support sickness procedures if changes cannot be agreed. A replacement note is not required for that reason.
Can someone return before the note expires?Yes. Discuss the return and any support needed. They do not need a separate note signing them back to work.
What if the issuer's details are missing?A fit note needs the authorising healthcare professional's name or signature. Ask for valid evidence if neither is present; do not assume every document must be accepted without checks.

In practice

A part-time employee: three missed shifts, eight calendar days

A colleague normally works Monday, Wednesday and Friday. They become ill on Wednesday and are still unwell the following Wednesday. By Tuesday, they have missed three scheduled shifts, but seven consecutive calendar days have passed. Wednesday is day eight, so the fit-note threshold has been reached.

Keep the consecutive-day count separate from the working days used for absence reporting or sick-pay calculations. When the note arrives, record its coverage, consider the work advice with the employee and set a follow-up date. Do not turn the three missed shifts into a three-day fit-note count.

Common questions

When can an employer ask for a fit note?

Only when the employee has been off sick for more than seven days in a row, counting non-working days such as weekends and bank holidays. For the first seven days the employee can self-certify, for example by confirming the dates on a form or by email when they return.

Can an employer ask for a fit note for less than seven days?

GOV.UK says employers can only ask for a fit note once the absence is more than seven days. Employees do not need medical evidence for shorter absences, and a healthcare professional may charge a fee for a note covering seven days or less.

Can you return to work before your fit note ends?

Yes. A fit note is advice, not a ban on working. If the employee feels able to come back before it ends, discuss the return and any support they need. They do not need a new note to say they are fit for work.

What does 'may be fit for work' mean for the employer?

It means the employee could work with some support, such as different hours, duties or a phased return. Discuss the suggestions with them. If you cannot agree changes, treat the employee as not fit for work for the period of the note.

Can I withhold sick pay if the fit note is late?

No. You cannot withhold Statutory Sick Pay just because the fit note arrives late. Follow up on the evidence separately from the pay decision.

Your next steps

  1. Confirm the first day and count every consecutive calendar day.
  2. Accept the permitted digital or printed evidence.
  3. Record coverage and a follow-up date without sharing unnecessary medical detail.
  4. Discuss support and agree a written return plan where adjustments are needed.
  5. Apply your documented retention schedule and review whether health records are still needed.
