Offering extra holiday days based on how long someone has worked for you is one of the simplest and most valued employee benefits in the UK. Service-based entitlement (sometimes called long-service leave or loyalty leave) rewards employees who stay with the business by gradually increasing their annual leave allowance. This guide covers how it works, common structures, the legal position, and how to implement it without creating an administrative headache.

What is service-based leave entitlement?

Service-based entitlement is a policy where employees earn additional paid holiday days the longer they work for the organisation. Rather than every employee receiving the same number of days regardless of tenure, the allowance increases at defined milestones — for example, after 2 years, 5 years, or 10 years of continuous service.

It's a contractual benefit, not a statutory one. The employer chooses whether to offer it, how it's structured, and at what milestones the extra days are awarded.

Common UK entitlement structures

There is no standard formula, but most UK businesses follow one of these patterns:

Gradual increase

The most common approach adds one extra day at regular intervals:

  • Start: 25 days + bank holidays
  • After 2 years: +1 day (26 total)
  • After 3 years: +1 day (27 total)
  • After 4 years: +1 day (28 total)
  • After 5 years: +1 day (29 total)
  • Cap: 30 days (reached after 7 years)

Is there a legal requirement to offer extra leave for service?

No. There is no UK statutory requirement to increase annual leave based on length of service. The statutory minimum of 5.6 weeks (28 days for full-time workers, including bank holidays) applies regardless of how long someone has worked for you.

However, once you offer service-based entitlement in a contract or policy, it becomes a contractual entitlement. You cannot reduce it without the employee's agreement. This is important to understand before implementing it — you're creating a commitment that's difficult to undo.

There's also an age discrimination consideration. The Equality Act 2010 prohibits less favourable treatment based on age. Since length of service correlates with age, a service-based entitlement scheme could theoretically be challenged. However, regulation 32 of the Employment Equality (Age) Regulations provides a specific exemption: employers can use up to 5 years of service as a criterion for benefits without needing to justify it. Beyond 5 years, you should be able to show that the benefit "fulfils a business need" — which is usually straightforward (e.g., rewarding loyalty, reducing turnover).
