Leave Management for Law Firms UK: Balancing Billable Hours and Time Off

Law firms have a conflicted relationship with leave. The billable hour model creates constant pressure to be at your desk. Taking a week off means losing 35 to 40 billable hours, which directly hits revenue and personal targets. Yet the legal profession has some of the worst burnout and mental health statistics of any sector. Getting leave management right is both a wellbeing imperative and a retention strategy. This guide covers the unique challenges law firms face and practical solutions that work.

The billable hour problem

In most law firms, fee earners are measured on billable hours. Annual targets vary, but 1,200 to 1,500 billable hours per year is typical for solicitors at UK firms. That translates to roughly 6 to 7 billable hours per working day.

When a solicitor takes a week of annual leave, they lose around 30 to 35 potential billable hours. Over a year with 25 days of holiday, that is 150 to 175 hours of lost billing. This creates an implicit (and sometimes explicit) pressure not to take leave.

The healthy approach:

  • Pro rate billable hour targets. If the annual target is 1,400 hours and a solicitor takes 25 days of leave, calculate the target based on the 227 working days they are actually available, not 252. This simple adjustment removes the penalty for taking leave.
  • Do not rank or compare fee earners without adjusting for leave taken. If Partner A took 15 days off and Partner B took 30 days off, their raw billing numbers are not comparable.
  • Track non-billable time properly. Leave, training, business development, and pro bono work should all be recorded so that "utilisation rate" calculations are meaningful.

Fee earners vs support staff

Law firms typically have two distinct groups of staff with different leave dynamics:

Fee earners (solicitors, associates, partners)

  • Leave is constrained by case deadlines, court dates, and client expectations.
  • Approval often needs to come from a team leader or practice head.
  • Cover arrangements are complex because cases are personal to the fee earner.
  • Partners (equity and salaried) may have different terms from associates.

Support staff (paralegals, legal secretaries, receptionists, IT, finance)

  • Leave is more straightforward to manage, similar to any office environment.
  • Cover is easier because tasks can be shared or delegated.
  • Entitlements are often lower than fee earner packages.

Having separate leave policies (or at least separate approval workflows) for each group makes practical sense. A paralegal requesting a day off next week is a different conversation from a solicitor requesting a week off during a trial preparation period.

Court dates and minimum notice periods

One of the unique constraints in law firms is court commitments. A solicitor with a trial listed for 14 March cannot take that week off, regardless of when they submitted the leave request. Some practical rules:

  • Require leave requests before cases are listed. Encourage fee earners to plan and book leave well in advance, and check their diary for conflicts before approving.
  • Make it clear that court listings take priority. If a trial date is set after leave was approved, the leave may need to be rescheduled. State this in your leave policy.
  • Set a minimum notice period. Two weeks for short breaks, four weeks for a week or more. This gives time to check for case conflicts.
  • Maintain a handover process. Before a fee earner goes on leave, they should brief a colleague on all active matters, with file notes and client contact details readily accessible.

Partner vs employee leave

In traditional partnerships, equity partners are self-employed and set their own leave terms. In practice, many partners take less leave than their employed colleagues because of the pressure to bill and the sense of ownership.

This creates a cultural problem. If partners visibly work through their holidays and send emails at 10pm on a Sunday, junior staff feel they cannot take leave either. Partners need to model healthy leave behaviour.

For salaried partners and associates, leave terms are set by the partnership agreement or employment contract. Typical entitlements:

  • Newly qualified solicitors: 25 days plus bank holidays.
  • Associates (3 to 7 years PQE): 25 to 28 days plus bank holidays.
  • Senior associates and salaried partners: 28 to 30 days plus bank holidays.
  • Equity partners: Typically "reasonable leave" with no fixed number. In practice, 4 to 6 weeks.

Approval delegation

In law firms, leave approval often sits with a single team leader or department head. When that person is on leave themselves (or in court), leave requests sit unapproved and staff cannot plan.

The solution is approval delegation: temporarily assigning approval authority to another senior person when the usual approver is unavailable. This keeps the process moving and prevents a backlog of pending requests when the team leader returns.

Burnout prevention in law firms

  • Monitor leave usage. If a solicitor has not taken any leave by Q2, flag it proactively. Do not wait until December when they have 20 days to use before year end.
  • Enforce minimum leave. Some progressive firms require fee earners to take at least one full week (5 consecutive days) per quarter. This forces real rest, not just scattered half days.
  • Offer mental health days. A small allocation (2 to 3 per year) of days that can be taken at short notice without a sick note sends a powerful signal about wellbeing.
  • Limit out of hours contact during leave. Set a firm policy: no emails, no calls to staff on leave unless it is a genuine emergency. Designate a cover person and trust them.
  • Senior staff must model the behaviour. Partners and senior associates taking their full leave entitlement gives permission to everyone else.

TOIL for late nights and weekend work

Solicitors frequently work late nights and weekends, particularly around deal completions, court deadlines, and month end. If your firm does not pay overtime (most do not for fee earners), TOIL is a fair way to compensate for these extra hours.

A TOIL policy for a law firm should specify that extra hours must be pre-approved (or at least acknowledged after the fact by a supervisor), set a reasonable cap on accrual, and require TOIL to be used within a set period.
