Holiday and pay
Sick during annual leave: UK employer rules for reclaiming holiday
If an employee is ill just before or during their annual leave, they can take those days as sick leave instead and use the holiday later. They must report the sickness to you in the usual way, and they are paid sick pay rather than holiday pay for those days. You cannot make someone use annual leave for time they are off sick.
- Holiday days lost to sickness can be taken later
- Reclaim
- Self-certified before a fit note can be asked for
- 7 days
- Carried over after long-term sickness, used within 18 months
- 4 weeks
Guidance for England, Scotland and Wales. Northern Ireland employment rules can differ. Checked against GOV.UK, Acas and legislation.gov.uk in October 2026.
Can an employee reclaim annual leave if they are sick on holiday?
Yes. GOV.UK says that if an employee is ill just before or during their holiday, they can take it as sick leave instead. The days of sickness stop counting as annual leave, and the holiday goes back into their balance to take at another time.
The right is not automatic. Acas says the worker must report their sickness to the employer if they want any holiday to count as sick leave. Someone who stays quiet during the holiday and mentions a cold weeks later has not followed that step, so set out in your absence policy how and when sickness on holiday must be reported.

How should sickness during holiday be reported and evidenced?
Treat it like any other sickness absence. Ask the employee to contact their manager on the first day of illness, using the same reporting route as a normal working day, and to say which booked days they want to count as sick leave.
The usual evidence rules apply. An employee does not need to give a fit note or other proof for sickness of seven days or less, and can self-certify on return. You can ask for a fit note once they have been ill for more than seven days in a row. If your policy asks for anything more, apply it in the same way to everyone.
- Report on the first day of sickness, not on return from holiday
- Say which booked days are affected
- Self-certify for seven days or less
- Provide a fit note if sickness lasts more than seven days in a row

What pay applies to sick days that were booked as holiday?
Once the days are sick leave, sick pay applies to them, not holiday pay. An eligible employee receives Statutory Sick Pay of up to £123.25 a week for 2026/27, for up to 28 weeks, or company sick pay if your contract offers more. Holiday pay is paid later, when the restored days are actually taken.
This can leave the employee with less money for that week if they have no company sick pay. Some people therefore prefer to keep the days as holiday. Acas advises that the employer and worker discuss whether the time counts as sickness or holiday and which pay applies, and put any agreement in writing.
| Situation | What happens | Pay |
|---|---|---|
| Ill just before or during booked holiday, and reports it | Days become sick leave; holiday restored to the balance | SSP or company sick pay for the sick days |
| Off sick and asks to take holiday instead | Employer may approve; sick leave pauses for the holiday | Holiday pay |
| Off sick, employer wants them to use holiday | Not allowed: the employer cannot force it | Sick pay continues |
| Long-term sick across the leave year end | Untaken statutory holiday carries over | Holiday pay when taken |

Can an employer make someone take holiday while off sick?
No. GOV.UK says employers cannot force employees to take annual leave when they are eligible for sick leave, and Acas says the same. The choice sits with the employee.
An employee can ask to take paid holiday while off sick, for example because company sick pay has run out and holiday pay is higher. If you agree, the sick leave pauses during the holiday and they receive holiday pay for those days.

Does holiday build up during sick leave, and can it be carried over?
Statutory holiday keeps building up while an employee is off sick, however long the absence lasts. Any statutory holiday that cannot be taken because of illness can be carried over into the next leave year.
Acas says a worker on long-term sick leave can carry over a maximum of four weeks' holiday, which must be used within 18 months of the end of the leave year in which it was built up, unless the employer allows more. Holiday you give above the statutory minimum follows your contract, so say in writing what happens to it.

What to put in your sickness during holiday policy
A short clause avoids most disputes. It should explain the reporting route, the evidence you will ask for, which pay applies to the converted days and how the restored holiday is rebooked. Managers should change the record promptly so the employee's remaining balance is correct.
Keep sickness on holiday visible in the sickness record. Leaving it booked as holiday hides the absence, while recording it twice overstates both the sickness record and the holiday used.

In practice
Five days of holiday, three days of flu
An employee books Monday to Friday as annual leave. On Wednesday morning they develop flu and phone their manager, as the sickness policy requires, asking for the rest of the week to count as sick leave. They are fit to return the following Monday.
Monday and Tuesday stay as annual leave. Wednesday to Friday become sick leave: three days, so the employee self-certifies on return and no fit note is needed. Those days are paid as SSP if they qualify, or company sick pay if the contract provides it, and three days go back into their holiday balance to book again before the end of the leave year.
Common questions
Can I get my annual leave back if I was sick on holiday in the UK?
Yes. If you are ill just before or during your holiday, you can take those days as sick leave instead and use the holiday later. You must report the sickness to your employer, following its normal sickness reporting rules.
Do I get holiday pay or sick pay if I am ill during annual leave?
If the days are converted to sick leave, sick pay applies: Statutory Sick Pay if you qualify, or company sick pay if your contract gives it. You receive holiday pay later, when you take the restored holiday.
Does an employee need a fit note for sickness during holiday?
Only if they are ill for more than seven days in a row. For seven days or less they can self-certify, and the employer cannot require a fit note for that period.
Can an employer refuse to give holiday back after sickness?
If the employee was genuinely ill and reported it, the employer should treat the days as sick leave and let the holiday be taken later. An employer can expect its reporting and evidence rules to be followed, applied consistently.
Can my employer make me use annual leave while I am off sick?
No. Employers cannot force employees to take annual leave when they are eligible for sick leave. An employee can ask to use holiday while off sick, and if the employer agrees, holiday pay applies.
What happens to holiday if someone is off sick for the whole leave year?
Statutory holiday keeps building up during sickness. Acas says up to four weeks can be carried over and must be used within 18 months of the end of the leave year in which it was built up.
Your next steps
- Write a sickness-on-holiday clause into your absence policy.
- Require sickness to be reported on the first day, not on return.
- Apply the normal seven-day self-certification and fit note rules.
- Pay sick pay for the converted days and restore the holiday balance.
- Never require an employee to use holiday for time they are off sick.
- Track carried-over holiday after long-term sickness and its 18-month deadline.
